Privacy Policy

  1. Introduction.
    • Website Owner. Element 47, LLC (“Company”) is the owner of this website, element47.co (“Site”). Company can be contacted by mail at 3050 Business Park Circle, Suite 300, Goodlettsville, Tennessee 37072, by phone at (629) 234-0047, or by e-mail at info@element47.co. This online privacy notice discloses Company information practices for this Site, including what type of personal identifiable information is requested in order to contact the Site, how the information is used, and with whom the information is shared.
    • Website Visits. In this Privacy Policy, the words “you” and “your” refer to each Site visitor or user, “we”, “us” and “our” refer to Company. Company collects certain information from Site visitors. This includes, but is not limited to, the home server domain name, e-mail address, type of computer and web browser, what pages visitor accessed, and limited information about search requests. This information is used to solve technical problems and to calculate overall usage statistics.
    • Website Transactions. At times, Company will need personal information regarding a user or a prospect. For example, to process an order or provide a subscription, Company may need to know a user’s name, mailing address, e-mail address and credit card details. It is Company’s intent to inform you before Company collects personal information, such as user’s name and/or address. If you tell us that you do not wish to have this information used as a basis for further contact with you, Company will respect your wishes.

Company may request additional information necessary to establish and maintain user’s account.

Company does not sell products or services for purchase by children, and will not knowingly collect or post information from a child under the age of 18 without the involvement of a parent or guardian. Company does not knowingly use personally identifying information collected from children for marketing or promotional purposes, and does not knowingly disclose such information to any third party for any purpose whatsoever.
    • Lost or Stolen Information. Help keep your personal information accurate. If a user’s personal information has changed, please e-mail the new information to Company at the e-mail address shown in Paragraph 1(a). If a user would like to review the personal information Company has in its files regarding the user, e-mail your request to Company.
    • Links to Other Websites. Company Website may contain links to other websites. Company is not responsible for the privacy practices or the content of those other websites.
  3. Uses Made of the Information.
    • Limited Uses Identified. Without user’s prior consent, Company will not use your personal identifiable information for any purpose other than that for which it is submitted. Company uses personal identifiable information to reply to inquiries, handle complaints, provide operational notices and in program record-keeping. Company also processes billing and business requests related to Company Website participation.
    • Marketing Uses. Unless user opts-out, Company reserves the right to provide user with information about Company’s Website, Company products and services, and related information.
    • Stored Information Uses. Company stores and retains the information provided by user. Stored information is used by Company agents: to support user interaction with the Site; to deliver user purchases; and/or to contact user again about other Company services and products.
    • Online Advertising. Some companies that help Company deliver interactive on-line advertising, such as banner ads, may collect and use information about Company’s users to help Company better understand the types of advertising or promotions that are most appealing to Company’s users. Generally, the information is aggregated so it is not identifiable to a specific individual. If, however, user would prefer that these companies not collect such information, please opt-out by emailing company.

    • Domestic and International. Company may share your personal information within the Company, and may transfer the information to third parties outside of the United States with whom Company conducts business. Some countries may provide less legal protection for user’s personal information. In such countries Company will still handle user’s personal information in the manner described herein.
    • Mergers and Acquisitions. Circumstances may arise where for business reasons, Company decides to sell, buy, merge or otherwise reorganize its businesses in the United States or some other country. Such a transaction may involve the disclosure of personal identifying information to prospective or actual purchasers, and/or receiving such information from sellers. It is Company’s practice to seek appropriate protection for information in these types of transactions.
    • Agents. Company employs or engages other companies and individuals to perform business functions on behalf of Company. These persons are provided with personal identifying information required to perform their functions, but are prohibited from using the information for other purposes. These persons engage in a variety of functions which include, but are not limited to, fulfilling contracts, delivering services, removing repetitive information from user lists, analyzing data, providing marketing assistance, processing credit card payments and providing user services.
    • Affiliated Businesses. Company may work with third party businesses across an array of industries in order to provide services. User information related to a transaction with an affiliated business is shared with that affiliated business.
    • Marketing Analysis by Third Parties. Company reserves the right to disclose to third parties personal information about users for marketing analysis; however, any information disclosed will be in the form of aggregate data that does not describe or identify an individual user.
    • Disclosure to Governmental Authorities. Company may release personal information to appropriate governmental authorities where release is required by law (for example, a subpoena) or by a regulation, or is requested by a government agency conducting investigations or proceedings.
  5. Use of Computer Tracking Technologies.
    • No Tracking of Personal Information. Company’s Site(s) are not set up to track, collect or distribute personal information not entered by visitors. Through website access logs Company does collect clickstream data and HTTP protocol elements, which generate certain kinds of non-identifying site usage data, such as the number of hits and visits to our sites. This information is used for internal purposes by technical support staff for research and development, user analysis and business decision making, all of which provides better services to the public. The statistics garnered, which contain no personal information and cannot be used to gather such information, may also be provided to third parties.
    • Use of Cookies. Company, or its third party vendors, collects non-identifiable and personal information through the use of various technologies, including “cookies.” A cookie is an alphanumeric identifier that a website can transfer to user’s hard drive through user’s browser. The cookie is then stored on user’s computer as an anonymous tag that identifies the user’s computer, but not the user. Cookies may be sent by Company or its third party vendors.
    • Use of Web Beacon Technologies. Company may also use Web beacon or other technologies to better tailor its Site(s) to provide better user service. If these technologies are in use, when a visitor accesses these pages of the Website, a non-identifiable notice of that visit is generated which may be processed by Company or by its suppliers. Web beacons usually work in conjunction with cookies.
    • Collection of Non-Identifiable Information. Company may collect non-identifiable information from user visits to the Company Site(s) in order to provide better user service. Examples of such collecting include: traffic analysis, such as tracking of the domains from which users visit, or tracking numbers of visitors; measuring visitor activity on Company Site(s); Site and system administration; user analysis; and business decision making. Such information is sometimes known as “clickstream data.” Company or its contractors may use this data to analyze trends and statistics.
    • Collection of Personal Information. Company collects personal identifying information from user during a transaction. Company may extract some personally identifying information about that transaction in a non-identifiable format and combine it with other non-identifiable information, such as clickstream data.       • Google Analytics (Google LLC)—Google Analytics is a web analysis service provided by Google LLC (“Google”). Google utilizes the data to track and examine the use of this website, to prepare reports on its activities and share them with other Google Services. Google may use the data collected to contextualize and personalize the ads of its own advertising network. Personal data collected: cookies, usage data.
      • Google Tag Manager (Google LLC)—This service helps the Company manage the tags or scripts needed on this website in a centralized fashion. This results in the Users’ data flowing through these services, potentially resulting in the retension of this data. Google Tag Manager is a tag management service provided by Google LLC. Personal data collected: cookies, usage data.
        • Place of processing United States – Privacy Policy. Privacy Shield participant.
      • Advertising & Remarketing—The Company may use remarketing or similar audiences to advertise online, including Google Ads, Facebook Ads, and other advertising networks. These companies serve ads on sites across the Internet, using cookies to service ads based on Users’ past visits to this website. Users can opt out of a third-party vendor’s use of cookies by visiting the Network Advertising Initiative opt-out page: http://optout.networkadvertising.org.
  1. Information Security.
    • Commitment to Online Security. Company has appropriate security measures in place to prevent personal information from being accidentally lost or used or accessed in an unauthorized way. We limit access to your personal information to those who have a genuine business need to access it. Those processing your information will do so only in an authorized manner and are subject to a duty of confidentiality. We also have procedures in place to deal with any suspected data security breach. We will notify you and any applicable regulator of a suspected data security breach where we are legally required to do so.
    • No Liability for Acts of Third Parties. Company will exercise all reasonable efforts to safeguard the confidentiality of user personal information. However, transmissions protected by industry standard security technology and implemented by human beings cannot be made absolutely secure. Consequently, Company shall not be liable for unauthorized disclosure of personal information due to no fault of Company including, but not limited to, errors in transmission and unauthorized acts of Company staff and third parties.
  2. Privacy Policy Changes and Opt-Out Rights.
    • Changes to Privacy Policy. This privacy notice was last updated on February 6, 2020. Company reserves the right to update its privacy policy statement at any time. Company will notify you by email or on our Website whenever there is a change in our Privacy Policy.
    • Opt-Out Right. Users and prospective users have the right at any time to cease permitting personal information to be collected, used or disclosed by Company and/or by any third parties with whom Company has shared and/or transferred such personal information. Right of cancellation may be exercised by contacting Company via e-mail at info@element47.co, telephone or postal mail. After processing the cancellation, Company will delete user’s or prospective user’s personal information from its database.
  3. Access Rights to Data.
    • Information Maintained by Company. Upon user’s request, Company will provide a reasonable description of user’s personally identifiable information that Company maintains in its database. Please note that you may only make a CCPA-related data access or data portability disclosure request twice within a 12-month period. Company is not obligated to make a data access or data portability disclosure if we cannot verify that the person making the request is the person about whom we collected information, or is someone authorized to act on such person’s behalf.
    • Corrections and Changes to Personal Information. Help Company to keep user’s personal information accurate. If user’s personal information changes, or if user notes an error upon review of user information that Company has on file, please promptly e-mail Company at info@element47.co and provide the new or correct information.

    • Questions, Problems and Complaints. If you have a question about this policy statement, or a complaint about Company compliance with this Privacy Policy, you may contact Company by e-mail at info@element47.co.
    • Terms of Use. If user chooses to continue to utilize the Site, user’s action is hereby deemed acceptance of Company practices described in this policy statement. Any dispute over privacy between user and Company is subject to the provisions of this notice and to Company’s Terms of Use Agreement which is hereby incorporated herein and which can be read here.
